Delaware cannabis regulators have received more than 1,260 adult-use cannabis business applications ahead of the state’s September 30 deadline.

Delaware’s Booming Cannabis Industry
As Delaware continues to embrace the cannabis industry, regulatory bodies have reported an influx of business applications. With over 1,260 applications filed before the September 30 deadline, the state is poised for significant growth in the adult-use cannabis sector.
The Delaware Office of the Marijuana Commissioner revealed that the applications have resulted in more than $4 million in revenue from application fees. This includes standard application fees of $5,000, microbusiness fees at $3,000, and social equity fees priced at $1,000.
Lottery System for License Distribution
To navigate the overwhelming number of applications, Delaware is implementing a lottery system. The first round, focusing on cultivation licenses, is scheduled for October 24. A thorough review of all applications will be conducted by regulators prior to this lottery.
Application Status Breakdown
Data reveals that more than half of the submitted applications aim for either “Open Retailer” or social equity retail licenses. Open licenses are available to any applicant statewide, whereas social equity applications target communities historically underrepresented due to previous cannabis laws. This initiative seeks to support individuals with prior cannabis-related convictions and residents from disproportionately impacted areas who have lived there for at least five of the past 15 years.
Future Licensing Rounds
The next phase in the licensing process includes a retail-only lottery projected for November or early December. Conditional licenses will be awarded to successful lottery applicants, leading to a more exhaustive secondary evaluation phase.
Remaining applications from those not selected in the lottery will be preserved, giving them a chance should subsequent applicants fail to secure a license.
