However, months have passed, and there has been little progress made in addressing the alarming rise of illicit e-cigarettes flooding the market.

Despite the promises made by the FDA, numerous manufacturers of disposable e-vapor products continue to blatantly ignore FDA regulations, which mandate the submission of product applications for review. As a result, the market has seen a significant influx of unregulated products — a threefold increase in just four years. A substantial portion of these products comes from China, with several companies reportedly linked to the Chinese Communist Party. Flavored e-cigarette brands such as Elf Bar have surged in popularity among American youth, raising serious concerns.

Chinese tobacco companies are seemingly allowed to introduce their unregulated products into the United States without facing any consequences. This has prompted bipartisan Senators to send a letter to Dr. Brian King, head of the FDA’s Center for Tobacco Products, seeking clarification on the apparent lack of urgency and transparency surrounding the COVID-19 response.
