The Current Landscape of Microbusiness Cannabis Licenses in Missouri

JEFFERSON CITY, MO — The Missouri Division of Cannabis Regulation (DCR) has made a significant decision by revoking 25 microbusiness cannabis facility licenses during the second round of licensing under the Missouri voter-approved regulatory program.

Understanding Microbusiness Licenses

In accordance with Article XIV, microbusiness licenses are specifically tailored for cannabis businesses that operate on a smaller scale compared to medical or comprehensive licenses. This regulatory framework establishes essential eligibility criteria, ensuring that the majority owners of these microbusinesses possess specific qualifications. Among these, having a net worth of less than $250,000 or being a veteran with a service-connected disability are pivotal eligibility benchmarks.

Accessing Opportunities in Cannabis Ownership

The microbusiness program is designed to demystify and facilitate greater access to cannabis facility ownership for individuals who may have previously been excluded from such opportunities. The essence of this program lies in its intention to level the playing field for aspiring cannabis entrepreneurs.

License Revocation Process

As part of its ongoing oversight responsibilities, DCR must verify the conformity of microbusiness licenses with the regulations governing ownership eligibility. This entails continuous monitoring of ownership structures—even subsequent to any changes made—thereby ensuring compliance with Article XIV.

In October 2024, the DCR issued 32 Notices of Pending Revocation (NOPR) to microbusiness licensees that had received their licenses on July 24, 2024. Each NOPR articulates the grounds for the impending revocation, allowing licensees a minimum of 30 days to respond. Within this timeframe, they can present evidence that counters the allegations or demonstrates compliance.

Outcomes of License Review

Upon conducting a meticulous review, DCR ascertain that seven licensees met the standards outlined in their respective NOPRs. However, 24 licenses faced revocation due to failure in proving majority ownership and operational compliance by eligible individuals, in alignment with regulations stipulated in 19 CSR 100-1.190(1)(B)1-5 and Article XIV Section 2.4(12) and (13). Additionally, one license was revoked due to a disqualifying felony offense. These revocations became effective on April 14, 2025.
