Vaping has become a growing trend among people of all ages, especially teenagers. It has become such a widespread issue that it is now considered an epidemic. Marshall County Schools have decided to take a zero-tolerance approach to vaping in their schools, recognizing the detrimental impact it has on students’ education and well-being.

Marshall County Circuit Judge, Jay Mastin, acknowledges that law enforcement and schools are doing their best to tackle the vaping problem. However, they are facing challenges in effectively addressing the issue. One of the main problems they face is the addictive nature of nicotine, the primary substance found in vapes. Judge Mastin explains that nicotine addiction is harder for teenagers to overcome compared to other substance addictions they encounter in juvenile treatment courts.

Not only does vaping pose health risks due to the high concentration of nicotine, but it also presents difficulties in detecting the substances being vaped. Unlike traditional cigarettes, vapes come in different flavors and scents, making them appealing to young people. Moreover, the discreet nature of vapes allows students to easily use them without being caught. This creates a hurdle for law enforcement to determine whether a student is using nicotine or THC (the psychoactive compound in cannabis) in their vapes.

The prevalence of vaping in schools has become a major distraction to both teachers and students who are focused on learning. In response to this concerning issue, Marshall County Schools, in collaboration with the court system, have come up with an innovative solution – the establishment of a unique Vape Court.

The Vape Court is a streamlined process designed to address vaping offenses. Each week, on Mondays at 8:30 a.m., a dedicated docket is set up to handle citations issued by school resource officers for vaping violations. By having a specific court for vaping-related cases, the aim is to expedite the legal process and ensure that consequences are promptly applied. The Vape Court also includes an educational component to raise awareness about the dangers of vaping and nicotine addiction.

Marshall County Schools’ Vaping Policy, which will be implemented during the 2023-2024 school year, outlines the consequences for students found in violation of the policy. For a first offense, students will face suspensions and community service, as well as an online course on vaping and nicotine awareness. If the student fulfills all the requirements within the allotted time, their case will be dismissed. Subsequent offenses carry more severe penalties, including alternative school placement, increased community service hours, fines, and disciplinary committee hearings. Offenses committed on school buses also result in bus suspensions and hearings.

It is important to note that participation in the Vape Court is not mandatory for all schools. Each city has the option to utilize their own city courts if they wish. However, the Vape Court serves as an additional resource available to all county and city schools within Marshall County.

The introduction of the Vape Court demonstrates a proactive approach by Marshall County Schools to address the alarming rise of vaping among students. By implementing stricter consequences and providing education on the dangers of vaping, they hope to steer students away from this harmful habit and create a healthier and more conducive learning environment.
